Intent: (1) The provision for a co-operative derogation (in paragraph 5 of Article 148), whereby the conditionality for the derogation would be that the co-operative’s statutes, or related documents, would “allow for democratic scrutiny and include fair contractual terms”.::(2) The member state derogation (in paragraph 6 of Article 148), whereby following consultation with farm representatives, the member state would be afforded greater flexibility to opt-out of the proposal for mandatory contracts. This amendment is in line with the position of the Council, albeit with some variation on the conditions that would govern the opt-out. ::We believe these amendments are balanced and appropriate and will improve the position of the European Parliament on this important initiative for our sector. Intent: • Due to our deep concerns CBAM will have for food security and its economic and environmental implications, we call on the Irish Government and MEPs to support the removal of fertiliser from CBAM under the new agricultural simplification package expected in Q4 2025. ::• To provide clarity and certainty to the sector, we call for an immediate postponement of CBAM obligations for fertiliser in 2026 due to the complexity and unworkable nature of the regulation. The absence of verified emissions, benchmarks and carbon prices creates an unacceptable and unmanageable risk for the fertiliser supply chain in Ireland. A postponement of CBAM for fertiliser is needed to put in place correct procedures to ensure price predictability at the time of import and invoicing.::• Furthermore, a postponement will ensure proper alignment between the EU and UK on CBAM.
